fa بنیان‌های فلسفی عدالت استحقاقی در آراء رابرت نوزیک عمومى General پژوهشي Research <div style="text-align: justify;"><span style="line-height:2;"><strong><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="color:#00000a"><span lang="FA">عدالت ابعاد و وجوه مختلفی دارد و هریک از مکاتب سیاسی و حقوقی تلاش می‌کنند تا دیدگاه خود را در ارتباط با تحقق آن مطرح کنند. یکی از انواع دیدگاههای مربوط به عدالت، رویکردی است که رابرت نوزیک به‌عنوان یکی از اندیشمندان لیبرال و راست نو مطرح کرده که تحت عنوان عدالت استحقاقی شناخته می‌شود. پرسش پژوهش حاضر این است که بنیان‌های فلسفی عدالت استحقاقی در آراء نوزیک چیست؟ بررسی حاضر با تحلیل آراء نوزیک به این نتیجه رسیده است که عدالت استحقاقی هنگامی معنا پیدا می‌کند که افراد بدون دخالت خودسرانۀ دولت به امور خود بپردازند و نقش دولت تنها محدود به دفاع از مالکیت خصوصی افراد، حفظ و حراست از آنها و همچنین فراهم کردن فرصت‌های برابری برای آنان، نسبت به تحقق آن بکوشند. در این رویکرد، اصل بر این است که عدالت استحقاقی نتیجه تلاش و کوشش فردی، احترام به مالکیت افراد در معنای حقیقی، پذیرش آزادی انسان در معنای فلسفی و سیاسی آن و کوشش برای رفع موانع که باعث سلب آزادی مالکیت و آزادی از نتایج فعالیت اقتصادی انسانی می‌شوند. در نهایت اینکه در چارچوب عدالت استحقاقی که آزادی مقدمه رسیدن به آن است، افراد یک جامعه به رشد و شکوفایی فردی می‌‌برسند. در این شیوه از عدالت، افراد به حکم اینکه انسان اند از حقوق طبیعی برابری برخوردارند و هیچ‌کس نمی‌تواند مانع نقض و یا نادیده گرفتن آنها شود. در مقاله حاضر از روش توصیفی ـ تحلیلی و ابزار کتابخانه‌ای استفاده شده است.</span></span></span></span><br> <br> <span dir="RTL" lang="AR-SA"><span style="color:#00000a">- </span></span><span dir="RTL"><span style="color:#00000a"><a href="http://philosophylawjournal.ir/search.php?slc_lang=fa&sid=1&author=%D8%B9%D8%A8%D8%AF%D8%A7%D9%84%D9%87" style="color:blue; text-decoration:underline"><span lang="AR-SA" style="border: 1pt none windowtext; padding: 0cm;">عبداله</span></a></span></span><span dir="RTL" lang="AR-SA">، عبدالمطلب<span style="color:#00000a">؛ </span>قاسمی، زهرا. One of the types of views related to justice is the approach proposed by Robert Nozick as one of the liberal and new right thinkers, which is known as meritorious justice. The question of the present research is, what are the philosophical foundations of deserving justice in Nozick&#39;s views? By analyzing Nozick&#39;s opinions, the present study has come to the conclusion that meritorious justice becomes meaningful when people deal with their affairs without the arbitrary interference of the government, and the role of the government is only limited to defending the private property of individuals, preserving and protecting them, and also providing Making equal opportunities for them, strive towards its realization. In this approach, the principle is that meritorious justice is the result of individual effort and effort, respect for the property of individuals in the true sense, acceptance of human freedom in its philosophical and political meaning, and an effort to remove the obstacles that cause deprivation of the freedom of property and freedom from the results of economic activity. They become human. Finally, within the framework of deserving justice, which freedom is the prelude to achieving, the members of a society reach individual growth and prosperity. In this way of justice, people have equal natural rights as they are human beings and no one can prevent them from being violated or ignored.
