fa فلسفه تقنینی کنوانسیون بیع بین‌المللی کالا 1980 وین فرصت‌ها و چالش‌ها پژوهشي Research <h1 dir="RTL" style="text-align: justify;"><strong><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="color:#00000a"><span lang="FA">طبیعت برون مرزی معاملات بین‌المللی و به‌طور عمده و اساسی، قراردادهای بیع بین‌المللی و تضمین آنها بر یک یا چند عنصر بین‌المللی، کارا نبودن قوانین ملی را برای پاسخگویی به مقتضیات و نیازهای ویژه بیع بین‌المللی آشکار نموده است. به همین جهت و با توجه به این که حقوق بیع، مهم‌ترین شاخه حقوق قراردادهای طی چند فرآیند دهه اخیر، جامعه حقوقی بین‌المللی با شناسائی مشکلات و آگاهی از نارسایی‌های قوانین کشورها، حرکتی را در جهت تدوین و یکپارچه ساختن قواعد حقوقی مربوطه، آغاز کرده است. یکی از تلاشهای چشمگیر و کارآمدی که در این راستا صورت گرفته است تصویب کنوانسیون بیع بین‌المللی کالا مورخ 11 آوریل 1980 توسط کنفرانس سازمان ملل متحد برای قراردادهای بیع بین‌المللی کالاست. تهیه‌کنندگان این کنوانسیون که نمایندگان کشورهای مختلف با نظام‌های اقتصادی، سیاسی و حقوقی گوناگون بودند، کوشیده اند تا با استمداد از عرف و عادت و گرایشهای غالب تجارت بین‌الملل و حفظ توازن بین حقوق آمده و نظم عمومی کشورها و نیز آزادی اراده طرفین تا حدود زیادی نظمی نوین را در عرصه تجارت بین‌المللی پی ریزی نموده و با رعایت برابری و غبطه متقابل طرفین قراردادهای بیع بین‌المللی، توسعه داد و ستد جهانی را تسهیل کنند. مقاله حاضر سعی دارد تا با واکاوی کنوانسیون بیع بین‌المللی 1980 وین بررسی اصول حاکم بر آن و ضمن بیان فرصت‌ها و چالش‌های موجود در زمینه اعمال آن اصول را در عرصه بین‌المللی آشکار نماید.</span></span></span></span></span></span></span></strong></h1> <div dir="RTL" style="text-align: justify;"></div> <div dir="RTL" style="text-align: justify;"><strong><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span dir="RTL" lang="AR-SA"><span style="color:#00000a">- بهبهانی</span></span><span dir="RTL" lang="AR-SA">، محمدرحیم. For this reason and considering that sales law is the most important branch of contract law during the last few decades, the international legal community, recognizing the problems and being aware of the inadequacies of the laws of the countries, started a movement in the direction of compiling and integrating the relevant legal rules. has done. One of the impressive and efficient efforts that have been made in this direction is the adoption of the Convention on the International Sale of Goods dated April 11, 1980 by the United Nations Conference on International Sale of Goods. The drafters of this convention, who were the representatives of different countries with different economic, political and legal systems, have tried to rely on the customs and habits and prevailing tendencies of international trade and maintaining the balance between the laws and the general order of the countries and the freedom of will of the parties to They have established a new order in the field of international trade and facilitate the development of global trade by respecting the equality and mutual respect of the parties to international sales contracts.
