fa فلسفه حقوق پزشکی؛ از مبانی و خاستگاه تا قلمرو دگردیسی تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="line-height:2;"><strong><span style="font-size:14px;"><span dir="RTL" lang="FA"><span style="color:#00000a">حقوق پزشکی رشته‌ای شناخته شده در زمان حاضر به شمار می‌رود که با توجه به اهمیت و جایگاه و حرکت رو به توسعه آن، نیازمند بازشناسی از منظر چیستی و چرایی و ماهیت‌شناختی است. در این نوشتار، با تأکید بر فلسفه حقوق پزشکی، به مبانی و ریشه‌ها و خاستگاه این رشته و قلمرو دگردیسی و تحولات آن خواهیم پرداخت. متأثر از سیطره اخلاق بر حقوق پزشکی و چالش‌های روزافزون فلسفی و اخلاقی که همگام با گسترش قلمرو پزشکی و موضوعات جدید، تشدید شده است، روابط در هم تنیده، پیچیده و چندوجهی در نظام سلامت میان ارائه‌دهندگان خدمات و دریافت‌کنندگان، قواعدی را می‌طلبد که حقوق پزشکی را شکل داده و آن را در فرآیندی رو به توسعه قرار داده است. در این میان، مبانی حقوق پزشکی از یک سو شامل نیروهای سازنده‌ای چون فطرت، عقل، عدل، عرف، مذهب و مصلحت است که قدرت پذیرش جمعی و الزام‌آوری، به قواعد به آن می‌دهند و از سویی دیگر، دلایل و عواملی نظیر لزوم مجازات و پیشگیری از جرایم و تخلفات پزشکی، صیانت از حقوق بیماران و تبیین بایدها و نبایدها در حوزه اعمال پزشکی را شامل می‌شود که ضرورت حقوق پزشکی را توجیه می‌کنند. </span></span></span></strong></span></div> <div style="text-align: justify;"><strong><span style="line-height:2;"><span style="font-family:Tahoma;"><span style="font-size:14px;"><span style="unicode-bidi:embed"><span style="color:#00000a">Medical law is a well-known field at the present time, which, due to its importance, position and development, needs to be recognized from the point of view of what it is and why it exists. In this article, with an emphasis on the philosophy of medical law, we will discuss the foundations and origins of this field and its metamorphosis and evolutions. Influenced by the domination of ethics over medical law and the ever-increasing philosophical and ethical challenges that have intensified along with the expansion of the medical field and new issues, the interwoven, complex and multifaceted relationships in the health system between service providers and recipients It claims to have formed medical law and placed it in a developing process.
