fa دورکین و دعاوی دشوار؛ تأملی بر نقش برجسته قاضی در نظام حقوقی تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="line-height:2;"><strong><span style="font-size:14px;"><span style="font-family:Tahoma;"><span dir="RTL" lang="FA"><span style="color:#00000a">حل دعاوی دشوار در نظام حقوقی، در جایی که نه قاعدۀ وضع‌شده و نه رویۀ قضایی وجود دارد، شاهکار کمی نیست؛ موضوعی که افزون بر حقوق، جنبه‌هایی از اخلاق، فلسفه و سیاست را نیز درگیر خود می‌کند. مسئلۀ اصلی دورکین در فلسفۀ حقوق، کوشش برای یافتن پاسخ درست در دعاوی دشوار و تعیین حدود اختیارات قاضی در این باره بوده است. بر این اساس، پرسش اصلی در مقالۀ حاضر با روش هنجاری و گردآوری اطلاعات به شیوۀ کتابخانه‌ای این است که &laquo;دیدگاه دورکین راجع به دعاوی دشوار و نقش قاضی در نظام حقوقی کدام است&raquo;؟ یافته‌های این پژوهش نشان می‌دهد دورکین با نقد دو مکتب حقوق طبیعی و به‌ویژه پوزیتیویسم حقوقی تلاش می‌کند تا با ابداع استانداردهای فراقاعده‌ایِ اصول و سیاست‌ها، تبیین اصل انسجام واضح و نیز تأکید بر قاضی هرکول و رویکرد کل‌گرایانۀ وی در نظام حقوقی، نقش برجستۀ قاضی در نظام حقوقی را موجّه‌سازی نماید؛ نظریه‌ای که می‌تواند به مثابۀ مبنایی نظری در تمایل روزافزون نظام‌های حقوقی به سوی حکومت قضات تلقی شود.</span></span></span></span></strong></span></div> <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><strong><span style="unicode-bidi:embed"><span style="color:#00000a">Solving hard cases in the legal system, where there is neither established rule nor judicial precedent, is no small fea; A subject that, in addition to law, also involves aspects of ethics, philosophy and politics. Dworkin&#39;s main question in the philosophy of law has been trying to find the right answer in hard cases and determining the scope of the judge&#39;s descretion in this regard. Based on this, the main question in the present paper with the normative method and information collection in a library style is &quot;What is Dworkin&#39;s point of view about hard cases and the role of the judge in the legal system?&quot;. The findings of this research show that Dworkin, by criticizing two schools of natural law and especially legal positivism, tries to invent extra-rule standards of principles and policies, explain the principle of articulate consistency, and also emphasize the judge Hercules and his holistic approach in the legal system, to justify the outstanding role of the judge in the legal system; a theory that can be considered as a theoretical basis in the increasing trend of legal systems towards the juristocracy.</span></span></strong></span><br> <br> <span style="line-height:90%"><span style="color:#00000a">- Yahyazadeh, J.
