fa فلسفه حق بر حق داشتن کودک در جهان آنلاین در پرتو اصل رعایت منافع و مصالح عالیه آنان The Philosophy of the Right to Have a Child in the Online World in the Light of the Principle of Respecting Their Best Interests تخصصي Special پژوهشي Research فناوری پدیده‌ای صرفاً فنی نیست، بلکه واجد ابعاد اخلاقی، فرهنگی و انسانی است و محیط دیجیتال، به مثابه فضایی دو وجهی، هم‌زمان فرصت‌های مهمی برای آموزش، آگاهی و دسترسی کودکان به دانش فراهم می‌کند و آنان را در معرض نقض حریم خصوصی، استثمار جنسی و سایر اشکال آسیب و تعرض دیجیتال قرار می‌دهد. در این میان، فلسفه حق کودک بر حق داشتن، بر مبانی عدالت، کرامت انسانی و توانمندسازی استوار است و مسئله اساسی، تبیین چارچوب حقوقی تضمین این حق در محیط دیجیتال است. پژوهش حاضر با رویکرد توصیفی ـ تحلیلی و با بهره‌گیری از منابع کتابخانه‌ای، اسناد بین‌المللی، رویه‌ها و آثار پژوهشی، درصدد تبیین این چارچوب است. یافته‌ها نشان می‌دهد که حمایت مؤثر از حقوق کودکان در محیط دیجیتال مستلزم تفسیر و اجرای جامع کنوانسیون حقوق کودک و پروتکل‌های اختیاری آن از طریق تدابیر تقنینی، اجرایی و قضایی و با تأکید بر نظارت مستقل، دسترسی به اطلاعات، آموزش و آگاهی‌بخشی، مشارکت جامعه مدنی و دسترسی مؤثر به عدالت و جبران خسارت است. در همین راستا، تفسیر عمومی شماره ۲۵ کمیته حقوق کودک، با شناسایی قابلیت اعمال حقوق مندرج در کنوانسیون در محیط دیجیتال، دولت‌ها را به انطباق قوانین و سیاست‌های خود با فرصت‌ها، مخاطرات و چالش‌های این محیط فرا می‌خواند. بر این اساس، تضمین حقوق کودک دیگر به محیط آفلاین محدود نیست، بلکه صیانت از کرامت، منافع و حقوق بنیادین کودک باید در فضای دیجیتال نیز به‌عنوان تعهدی حقوقی و مستمر مورد شناسایی و تضمین قرار گیرد.   Technology is not merely a technical phenomenon but also an ethical, cultural, and human one. As a dual-use environment, the digital sphere simultaneously creates significant opportunities for children’s education, awareness, and access to knowledge while exposing them to privacy violations, sexual exploitation, and other forms of digital harm and abuse. From the perspective of the philosophy of children’s rights, the child’s right to have rights is grounded in justice, human dignity, and empowerment. The central question, therefore, is how to establish an effective legal framework for guaranteeing this right in the digital environment. Adopting a descriptive-analytical approach and drawing on library-based sources, international instruments, jurisprudence, and relevant scholarly literature, this study examines the foundations and requirements of such a framework. The findings indicate that effective protection of children’s rights in the digital environment requires the comprehensive interpretation and implementation of the Convention on the Rights of the Child and its Optional Protocols through appropriate legislative, executive, and judicial measures, with particular emphasis on independent oversight, access to information, awareness-raising and education, civil-society participation, and effective access to justice and remedies. In this regard, General Comment No. 25 of the Committee on the Rights of the Child recognizes the applicability of Convention rights in the digital environment and calls upon States to adapt their laws and policies to the opportunities, risks, and challenges arising therein.
